Police must release all discovery to the defense. Willful omission or misrepresentation is a Felony.

§ 15A-903.  Disclosure of evidence by the State – Information subject to disclosure.

…(d)       Any person who willfully omits or misrepresents evidence or information required to be disclosed pursuant to subdivision (1) of subsection (a) of this section [statements of witnesses, defendant, co-defendants, notes, tests, exams or any other matter of evidence], or required to be provided to the prosecutor’s office pursuant to subsection (c) of this section [oral statements] , shall be guilty of a Class H felony. Any person who willfully omits or misrepresents evidence or information required to be disclosed pursuant to any other provision of this section shall be guilty of a Class 1 misdemeanor.
